County seeks easement solution

Cherokee County Attorney Mark Cozine recommends that the county vacate a tiny parcel of property it owns in Pilot Township in order to get out from the middle of a dispute between landowners.

"I'd recommend that we provide the access we are legally required to provide and abandon the rest of it," Mark Cozine told the Cherokee County Board of Supervisors on Tuesday.

There is apparently a long running dispute between property owners over an easement through county property that provides access to land owned by Steven and Diane Rochleau. Loni Loucks, another property owner in the area, allegedly put manure on this easement, a matter of discussion at the April 5 board of supervisors.

Steven Rochleau stated that this had not been the only incident regarding the easement.

At the supervisors meeting this week, Cozine said he had looked at the easement in question and there was nothing indicating that the manure had just been dumped in one location.

Cozine said that rather than get into a dispute over how much manure is too much, he had originally thought that the county should do nothing about the matter, but then there was another development since the April 5 board meeting. Holes have been dug and fence posts have been erected on county property across the easement. It hasn't been stated who erected the fence posts.

The first step in the process would be a survey of the property. A 66 foot wide section of road and road right of way would be retained by the county, a very short road. It was discussed that a fence on each side of the road might be needed.

The amount of county property involved is only 0.7 acre. With the road right of way taken out, the amount of county property to be abated would be even less.
