Spencer attorney new District Associate Judge

SIOUX CITY - Spencer attorney Charles K. Borth has been selected to fill the vacancy created by retiring District Associate Judge Donavon Schaefer, it was announced this week by Leesa McNeil, District Court Administrator for the Third Judicial District.

Borth was selected for the position by the five District Judges of the 3A Judicial Sub-District. He will assume his new position Oct. 1, and will work primarily in Clay, Cherokee, and Buena Vista counties.

Borth will, however, have jurisdiction in all counties of the Third Judicial District as assigned by the Chief Judge.

A native of Sleepy Eye, Minn., and a 1992 graduate of Mankato State University in Mankato, Minn., Borth graduated with honors from Drake University Law School in Des Moines in 1995. He is admitted to practice law in Iowa and the U.S. District Court, Northern District of Iowa.

Borth is a partner in the law firm of Zenor, Houchins, and Borth, and has served as assistant Clay County Attorney since 1997. Prior to working in the private sector, he served as a judicial law clerk.

Previously, the magistrate nominating commissions for Cherokee, Clay, and Buena Vista counties met to nominate three area attorneys to be considered for the District Associate Judge position that will be available Oct. 1, 2009, upon District Associate Judge Donavon Schaefer's retirement. Schaefer lives in Aurelia.

The nominees to fill the vacancy included attorneys Kristal Phillips of Cherokee, Dave Patton of Storm Lake, and Charles Borth of Spencer.

District Associate Judges hear serious and aggravated misdemeanor cases, small claims, hospitalization cases, as well as juvenile cases, and civil suits for judgment of up to $10,000.

District Associate Judges stand for retention election a year after their appointment, and at the end of their six-year term.

Borth will stand for a retention election in the November 2010 general election.
